Yasa dışı bir örgüt olarak kurulan Kürdistan Sosyalist Partisi (PSK) faaliyetlerini 42 yıl boyunca illegal olarak yürüttü.[3] 2016'da Türkiye Cumhuriyeti İçişleri Bakanlığına başvuran PSK yönetimi, yasal bir parti olarak çalışmalarına devam etti. Bu sırada Yargıtay Cumhuriyet Başsavcılığı, parti isminden Kürdistan kelimesinin çıkarılması hususunda parti yönetimini uyardı ancak başka bir işlem yapılmadı. Şubat 2019'da Yargıtay Cumhuriyet Başsavcılığı ismindeki "Kürdistan" kelimesini gerekçe göstererek Anayasa Mahkemesine PSK hakkında kapatma davası açtı.[3]
